Agreement
These Terms govern your access to and use of Benchmarke Portal. The portal is provided by Benchmarke for invited client contacts and Benchmarke admins to manage website account access, billing visibility, documents, work requests, and related support.
By accessing or using Benchmarke Portal, you agree to these Terms. If you use the portal for a company or other organization, you represent that you are authorized to use the portal on that organization's behalf.
Portal access
- Benchmarke Portal is invite-only. Public signup is disabled, and access may require an invitation, email/password authentication, Google sign-in, onboarding, and workspace membership.
- You are responsible for keeping your account credentials secure and for notifying Benchmarke promptly if you suspect unauthorized account access.
- Benchmarke may suspend or remove access if we believe an account is being misused, creates security risk, violates these Terms, or is no longer associated with an active client relationship.
- Workspace owners and admins may manage invited users and roles for their organization, subject to the controls available in the portal.
Acceptable use
You agree to use Benchmarke Portal only for legitimate client account and support purposes.
- Do not attempt to access another client's workspace, data, files, invoices, requests, or user information without authorization.
- Do not upload unlawful, harmful, malicious, infringing, or sensitive regulated content unless Benchmarke has expressly agreed to process it for the related client service.
- Do not interfere with portal security, abuse authentication flows, scrape the service, reverse engineer non-public code, or attempt to bypass access controls.
- Do not use the portal to send spam, harassing content, or requests unrelated to Benchmarke client services.
Client content
Client content includes information, documents, images, request details, comments, profile details, logos, banners, and similar materials submitted through Benchmarke Portal.
You retain ownership of client content you submit, subject to any separate agreement between you and Benchmarke. You grant Benchmarke permission to use, store, process, display, and transmit that content as needed to provide the portal and related client services.
Billing and payments
Benchmarke Portal may display Stripe invoice information and links to hosted Stripe invoice or payment pages. Stripe remains the source of truth for invoice payment processing.
The portal does not store card numbers, bank account details, or payment method data. Billing terms, payment due dates, taxes, late fees, refunds, and service commitments may also be governed by a separate agreement or invoice terms between Benchmarke and the client.
Third-party services
The portal may rely on third-party services for authentication, payments, email delivery, storage, hosting, and related infrastructure. Examples include Google for sign-in, Stripe for invoices and hosted payment pages, Mailgun for transactional email, and private object storage for files and images.
Your use of third-party services may also be subject to those providers' terms and privacy notices. Benchmarke is not responsible for third-party services outside our reasonable control.
Availability and changes
Benchmarke aims to keep the portal useful, secure, and available, but we do not guarantee uninterrupted or error-free access. We may change, suspend, or discontinue portal features as needed for security, maintenance, product improvement, or client service changes.
We may update these Terms from time to time. The updated date on this page shows when the current version took effect. Continued use of the portal after changes means you accept the updated Terms.
Confidentiality and security
The portal may contain confidential client, billing, and account information. You agree to protect information you access through the portal and to use it only for authorized purposes.
Benchmarke uses server-side authorization, invite-only account access, audit logging, and private file access controls to help protect portal data. You agree not to share portal access or downloaded materials with unauthorized people.
Disclaimers
Benchmarke Portal is provided on an as-is and as-available basis to the fullest extent permitted by law. Benchmarke disclaims warranties that the portal will be uninterrupted, error-free, or meet every specific requirement.
Nothing in the portal changes the terms of any separate written agreement between Benchmarke and a client unless that agreement expressly says otherwise.
Limitation of liability
To the fullest extent permitted by law, Benchmarke will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption arising from your use of the portal.
Where liability cannot be excluded, Benchmarke's liability will be limited to the greatest extent permitted by applicable law.
Governing law
These Terms are governed by the laws of Indiana, United States, excluding conflict of law rules. You agree to first contact Benchmarke to try to resolve any concern or dispute informally.
